February 5, Supreme Court Justice Scott DelConte ordered the votes be certified following several reviews and a recanvassing of votes in the eight-county district.  Special focus and the final hurdle was in Oneida County were several issues had been brought up since the November 3 election and Justice DelConte had ordered a stay last week.  The temporary injunction was lifted on February 5 and Oneida’s board of elections directed to certify the results. Final certification will be done by the New York State Board of Elections more than three months after election day, ending the only remaining contest for a seat in the House.

The lifting of the temporary halt finally gives Tenney the win over Incumbent Democrat Anthony Brindisi by 109 votes.  Brindisi’s appeals can continue as certification does not prevent the Democrat from a direct challenge of the results under Federal law.

Brindisi defeated Tenney for the seat in 2018, also in a close race but not as tight as Tenney’s 109 vote advantage.
