A Binghamton man, who won a retrial after being convicted of murdering another man outside the old Antler Lodge at the Chenango Street Viaduct in July 2015, is also expected to appeal his second conviction after again being sentenced to the maximum.

36-year-old Joshua Taylor was convicted in 2017 for the murder of James High then convicted again in December in a retrial.

He was sentenced March 16 to 25-years-to-life in prison.

Prosecutors say Taylor and High got into an argument which escalated and High was shot outside the bar.

The 2017 verdict was overturned when Taylor’s attorney successfully argued the judge should have instructed the jury about the meaning of circumstantial evidence as there had been no testimony from a witness specifically identifying Taylor as the shooter.

The retrial saw a witness point Taylor out in court as having a handgun after shots were heard.

Broome County District Attorney Michael Korchak says he’s pleased with the sentence and is prepared for another appeal.
