Panel Calls for Removal of Family Court Judge Richard Miller

A New York state commission has determined Broome County family court judge Richard Miller II should be removed from office because of numerous acts of misconduct.

Miller was served with a formal complaint containing four charges in July 2018. The determination in his case was made public Thursday.

According to the Commission on Judicial Conduct, Miller repeatedly made sexist and other demeaning statements to a female court clerk.

The commission also said Miller screamed at and belittled another female court clerk and retaliated against her after she filed a complaint.

Miller also was found to have failed to report income and pay appropriate taxes over a period of years.

Commission Administrator Robert Tembeckjian said Miller's actions "undermine public confidence in the courts and compel his removal from office."

According to the commission, a judge may accept a determination or may request a review by the state Court of Appeals.

If Miller does not request a review, the court will remove him in accordance with the determination.
