Judge Blocks Enforcing New York Flavored Vape Ban
A Supreme Court Justice is blocking New York State from enforcing that Executive Order banning flavored e-cigarettes and e-liquids.
Justice Catherine Cholakis said regulating the vaping industry is what the legislature should be doing, not the Governor.
The New York State Public Health and Health Planning Council last September issued a ban on vaping products flavored with anything other than tobacco or menthol.
Governor Andrew Cuomo said the Executive Order was issued out of concern for the health of young people in the state given a rapidly increasing number of reports of vaping illnesses and deaths.
The emergency ban was challenged by the Vapor Technology Association and member businesses.
